Three Sri Lankan asylum seekers’ deportations deferred
Three of the 40 failed Sri Lankan asylum-seekers, scheduled to be forcibly removed from Gatwick to Colombo tomorrow, have had their deportations deferred.
One of these cases, that of a young Tamil woman, was the subject of a judicial review – and the judge found in her favour. The other two deferrals are the result of a Home Office review, unprompted by any legal requirement to do so.
Channel 4 News understands that several other applications for judicial review are to be lodged on Thursday morning – just hours before the removal flight, a chartered Airbus A330 is due to take off for Sri Lanka. We have obtained a Government document confirming the intention to get the flight airborne by 5pm tomorrow night. 
The young woman, whose case will now be reconsidered, had complained that a potentially incriminating document had been passed to officials from the Sri Lankan High Commission in London by the Home Office. It had been in the possession of the UK Border Agency because it was part of her original asylum application.
The Home Office told me that the document concerned, an internal Sri Lankan police memo, had indeed been passed to the Sri Lankans as proof of the woman’s nationality. A spokesman denied, however, that this amounted to a breach of confidentiality as no personal details were contained in the document.
Channel 4 News has obtained a copy of the document however, and it does appear to contain personal information which her lawyers claim would have placed her in serious danger were she to have been deported.
The other two deferrals and the pending judicial reviews all relate to similar allegations, that potentially incriminating documentation had been passed to the Sri Lankans.

I met one of those seeking judicial review in an Immigration Removal Centre at Harmondsworth near Heathrow on Tuesday. He claimed he had been asked to take a sealed envelope to the Sri Lankan High Commission in London and was told it contained information confirming his nationality.
He told me that at the High Commission, this envelope was opened and its contents photocopied and that they included his original asylum application. The Home Office later denied that any incriminating information would ever be passed over in this manner.
But this has happened before. We have learned that a Tamil deported from the UK in the past was sent back with an envelope which he was told not to open. It turned out to contain an incriminating photograph of the man concerned standing with his brother who was dressed in the uniform of the Liberation Tigers of Tamil Eelam.

The man was abducted, blindfolded, beaten, tortured and detained on arrival in Sri Lanka. He later managed to get back to Britain and claimed asylum again on the basis of what had happened. An immigration judge believed his story and granted him leave to remain. I spoke to the man yesterday.
It is now possible, with tomorrow’s planned removal flight, that the entire flight may be grounded owing to concerns that others among the 40 to be removed have experienced similar problems. Lawyers say there is what they call a “systematic” problem at the Home Office and in this instance, they claim, it could be deemed sufficiently of concern to warrant mass-deferral.
Channel 4 News has obtained a letter from the Home Office’s solicitors to the Royal Courts of Justice regarding tomorrow’s flight. It quotes country guidance which states that: “Tamils are not per se at risk of serious harm from the Sri Lankan authorities in Colombo. A number of factors may increase the risk…”
It goes on to detail these risk factors, which include “return from London” and “having made an asylum claim abroad.” Because those being removed from Britain tomorrow arrive back on a chartered aircraft, it will be well known that they are failed asylum-seekers.
The Home office told us yesterday that: “Returns to Sri Lanka will only be undertaken if we are satisfied that the individual has no protection needs. The improving political and security situation in Sri Lanka has meant it is safe to remove people there.”
The UK Foreign Office report on Human Rights in Sri Lanka, published in April this year, says disappearances and extra-judicial executions still occur in the country, two years after the war ended. It says that the police and the judiciary have been politicised and that impunity rules.
The letter states that the UK Border Agency closely monitors developments in Sri Lanka. The reality is that Britain’s legal liability ends once a failed asylum seeker is back on Sri Lankan soil.

To give an idea of the truly horrific nature of the tamil tiger terrorists or LTTE and especially its leadership, I am recalling the tamil tiger attack against the srilanka army camp at mullaitivu in 1996.
During the battle in 1996 at least 1,200 srilankan army soldiers were killed by the tamil tigers. At least 207 srilankan soldiers who had surrendered to the LTTE or tamil tigers were executed with hundreds of sri-lankan army soldiers herded together, doused with gasoline, and burned alive. Burned alive! This is how sri-lankan army soldiers were massacred by the LTTE terrorists and this happened in 1996.

This is just one atrocity amongst the many thousands of atrocities committed by the LTTE in thirty years of war. Sadly nobody knows about these atrocities committed by the LTTE. Truly shameful.
Maybe if the Sri Lankan government hadn’t assasinated them all when the surrendered, the LTTE along with the Sri Lankan government could appear before the Internation Criminal Court.
Too bad they’re all dead and we have to concentrate on the atrocities carried out by the SLG and who continue to do so.

May 14 1986 Anuradhapura massacre: LTTE gunmen shoot dead 146 Sinhalese civilians and injure 85 others as they were praying at a sacred Buddhist shrine in Anuradhapura.
May 25 1986 Mahadivulwewa Village massacre: LTTE cadres shot dead 20 Sinhalese and set fire to 20 houses.
August 3 1990: Over 30 Tamil Tiger cadres attacked four Muslim mosques in Kattankudy in Batticaloa district, killing at least 147 Muslims who were praying in the mosques.
August 11 1990: Division 3 & 6 Eravur LTTE cadres attacked Div. 3 & 6, Eravur, killing 116 Muslims and injuring 20 others.
July 2 1997 Erakkandy Village Massacre: Over 100 LTTE terrorists wielding sharp weapons, clubs and firearms stormed Erakkandy Muslim village in Trincomalee and butchered 34 muslim civilians.
May 25 1995: LTTE cadres attack a fishing village in Kallarawa, and hack and shot to death 42 sinhalese civilians (22 males, twelve females and eight children)

Mithun, your numbers added up, do not even come close to the number of civilians that died in the space of 4 months. Your statistics are over 26 years?
Yes, what the LTTE was bad. But they are an organisation? The SL Army are members of the government. Isn’t it the government’s right to protect civilians, not kill them?
At the end of the day, this is not about LTTE? This is the number of people that were tortured by the government? Why punish all Tamils, not all of them represent the Tamil Tigers?
I would also like to thank Channel4 on behalf of all the Tamils. Thank-you for supporting us, and not giving up. We are grateful. Hopefully the world will not be blind to the situations that had occurred in Sri-lanka, and the people responsible will be punished.

it’s pity that C4 news exaggerates on LTTE members killed in Sri Lankan war against LTTE terrorists, when they dont say a word about how 1000s of Sri Lankan civilians got killed at the hands of LTTE. Who is there to take the blame for those now? Sri Lankans in Sri Lanka, tamils and sinhalese together, have started a new chapter and are trying to live alongside each other peacefully. Its obvious what a few bucks can do with an low grade international media like channel 4. Hope channel 4 will realize what they are doing and look at this issue from both sides.

Mithun – What have the crimes of the Tamil Tigers got to do this this article? This is about Britain having a responsibilty to be sure that failed asylum seekers are not endangered when they return to their countries. This can not be guaranteed in the case of Sri Lanka.

1998: August 29: The LTTE shoot down a AN-24 Lionair Flight 602 with 55 passengers (including 48 Tamils) and crew while it was flying over LTTE held territory. Everyone onboard is killed.
1998 September: In a massive LTTE terrorist offensive 1,500 srilankan soldiers are killed (Battle of Kilinochchi), 3,000 wounded and 500 are missing.
November 10 1993:Attack on Pooneryn army camp by LTTE terrorists: Eight officers and 233 srilankan army soldiers were declared killed in action in LTTE’s attack on the Pooneryn defences. The LTTE also executed 200 srilankan army soldiers captured during this attack on the Pooneryn army camp.
January 31 1996: Bombing of Sri Lanka’s Central Bank resulting in 91 civilian deaths.
March 19 1996: 29 Tamil civilians killed by LTTE, as they were accused of being traitors and giving information to Security Forces.
July 24 1996: Dehiwala train bombing where the LTTE exploded 4 bombs on Colombo-Alutgama train at Dehiwala killing 60- 70 civilians. The technique of simultaneously exploding multiple bombs in several carriages was used during this attack.
To whom comparing the attact of tamil tigers or LTTE, they were fighting for freedom and that war was between srilankan army/government and LTTE. They targeted army however, just cause LTTE killed few civilans in the conflict it does not justify the 100,000 civilans killed by sri lankan army. Also the government should not use example from LTTE, the state should have manily focused on the safety of the public. There was clear evidence from the Channel 4 document to show that the army/government were targeting at civilans. Targeting hospitals, bombarding safety zones are clear example of how much the government likes its tamil civilans. The videos broadcasted by C4 only a small part, what about alll the other parts that was not covered? This video was only an example of what would have happend to the rest of 100,000 people.

LTTE were the most barbaric terrorist group who killed and maimed innocent civilians with suicide bombers. They manage to create havoc in the small island because of the sympathy from unsuspecting europeans and financial support from their brethren living in the western world and the interference from the greedy western woprld governments and NGO’s. If LTTE did not have this support of the christian world the tamil civilians would not have ended up as human shields for the oncoming armed assault to save a nation.

When did the colonial legacy of divide and conquer triumph over a generation commited to the Buddhist principles of ahimsa and maitrieya, tolerance an compramise? It has been so in so many former colonial countries in Africa, Asia, South America and North America. The U.S fought its own bloody Civil War in which members of families took opposite sides instigated by the legacy of British rule. Colonial strategy has always been to divide and conquer and when they are forced to leave their colonies they try their best to covertly destroy countries that they can no longer pillage.
